The Alliance for the Union of Romanians (AUR) has announced that it will notify the People’s Advocate, immediately after its publication in the Official Gazette, regarding the review of the constitutionality of the train ordinance.

“Relieved, for the moment, of the burden of the elections, the Ciolacu 2 Government demonstrates once again the dysfunctionality of the administration it leads. Forced to give up the guise of elections, PSD – PNL – UDMR want to introduce a package of abusive measures in an abusive way. This measure adopted by the Government seriously violates the fundamental principles of the rule of law, the rights of taxpayers and the constitutional balance, having a devastating impact on the economy and the business environment in Romania”. says AUR in a press release, according to News.
AUR accuses the flagrant violation of the principle of fiscal predictability, citing the fact that, according to art. 4 para. (1) of the Fiscal Code, any legislative change in the fiscal field must be announced at least six months before it enters into force. At the same time, art. 6 para. (1) of the Fiscal Code provides that the fiscal rules must be clear, predictable and ensure uniform application.
“Through these sudden changes, companies are seriously affected, financial plans and already approved budgets are destabilized, and jobs are put at risk. Also, the notification emphasizes the lack of a real emergency that would justify the adoption of this ordinance”you emphasized the party.
According to the party, “in the case of the “Trenuleţ Ordinance”, the lack of an objective justification makes this measure a clear abuse of power, thus undermining the constitutional principles and affecting the democratic balance of the state”AUR also emphasized, showing that, “according to art. 115 para. (4) of the Romanian Constitution, emergency ordinances can only be issued in extraordinary situations, which cannot be postponed”.
Another aspect reported is the violation of the separation of powers in the state.
“The People’s Advocate has the responsibility to intervene quickly to notify the Constitutional Court and annul this abusive ordinance. We trust that the institution will do its duty and act promptly to protect taxpayers and the fundamental principles of the rule of law”conveyed George Simion, the president of AUR.
