A judge from the Craiova Court of Appeal criticizes the way in which the CSM communicates publicly and accuses the lack of assumption in the face of serious problems. “It’s, that’s why the people hate us,” she says.

Sorina Marinaș, a judge at the Craiova Court of Appeal, launched on Thursday, July 31, a series of harsh criticisms against the Superior Council of Magistracy (CSM), demanding a change in the way it communicates publicly and in which the internal problems of the judicial system are managed.
In a wide Facebook post, the magistrate talks about deformed communication, lack of transparency in promotions, unjustified delays in motivating decisions and an increasing wave of dissatisfaction from public opinion.
“I say, I don’t give the hair.
I believe that the way of public communication of the SCM, as an institution or through individual messages of the members, is deeply wrong and will not produce any good effect. Sterile communications or virulent individual statements, the moment being a tense one, produce the reverse effect ”, says the judge.
It criticizes the defensive attitude and somehow from a position of superiority of the system in relation to the citizens and the government, noting that an arrogant behavior will feed social hostility.
“We cannot keep the poem that we are magistrates and That’s it, we must receive without giving. Everything in life – professional or personal – is you get what you give.
If we treat the people and the government with Sictir – it is appropriate and cannot be modified, We are not talking to the Prime Minister That it has no duties, blah bla-we will receive custom feedback and attract a deep professional hatred ”, warns Sorina Marinaș.
The judge points out that justice cannot ask for respect and advantages if it does not offer quality and responsibility.
“I say to give (with the mention to give qualitative), to justify what we receive and to claim that we deserve”, add it.
Unresolved and unassuming issues
The list of irregularities in the system that the magistrate signals is a long and serious one: “form” promotions, non -transparent delegations and transfers, massive delays in drafting decisions and unjustifiably long court terms.
“The promotion has become a joke. What does the assessment of decisions without effective exam mean? What does the interview mean, especially at the JCCJ level? That we all know how these interviews go. E, that’s what we have to say public.says Sorina Marinaș.
It accuses the lack of consistency in the distribution of human resources and the lack of institutional reactions before the realities from the courts in the country: “What does delegations and detachments mean only by some and prolonged over the years?
Another critical point: the motivation of the late decisions over the years, an increasingly common and difficult to justify.
“No matter how many files you have, you can not justify 1-2 years of postponement. she says.
The magistrate also draws attention to the fact that Romania has already been convicted of the ECHR for non -observance of the deadlines, while the system ignores the signals received, and recommends “Maybe we still work on that professional evaluation …”.
Hypocrisy towards European values
Criticism also extends to how the system invokes European rights only when it suits them, but ignores them in practice.
“We prevail of recognized rights at European level of homologous professional categories, but when it comes to respecting the Union, especially CJUE, we pretend to rain”, says Marinaș, referring to the recent decisions regarding the prescription of criminal liability.
“He said CJUE that it is crazy with the prescription, we gave it with sovereignty and CCR, we are the candy on the cage. But we do not like the cage with the dead in the house,” the judge continues with sarcasm.
The chaos in the instances and the lack of reaction
Sorina Marinaș also talks about the precarious conditions in which the magistrates in Craiova work. Although the courts in the area have a high load, no one officially requests the supplementation of decent jobs or conditions.
“We have been promised in Craiova for decades a decent headquarters, but also in the car service”, “ she writes. “The Craiova District Court enters with 100+ criminal files on some meetings … Is anyone concerned?”
Her conclusion is sharp: the system cannot be expected to trust and public respect if it does not show honesty and self -criticism.
“It is, that’s why the people hate us. Because the people believe only the TV, prescriptions, allowances and pensions. And we communicate in Braille language,”
