The Craiova County Emergency Clinical Hospital was forced by the court to pay huge damages for the family of a little girl, who suffered serious sequelae after an infusion was wrong.

The magistrates of the Craiova Court of Appeal decided, at the end of November 2024, that the sanitary unit would pay the victim’s family damages worth 300,000 euros, in an action in criminal liability opened by the girl’s mother. The decision is not final and has already been appealed to the High Court of Cassation and Justice by both the hospital and the girl’s mother. The file is currently in the filter procedure at the supreme court, Craiovajust reports.
A little girl born in 2018 at the Craiova County Emergency Clinical Hospital was the victim of a medical error that changed her life forever. Although she was born healthy, a few days after birth, doctors identified health problems and decided to undergo her surgery. After the operation, she was admitted to the surgery section, where a nurse administered an infusion in an incorrect way.
Due to the procedure, the little girl has contracted an e-coli infection after which she remained with severe neurological sequelae.
According to the forensic report, the infusion was not properly administered in the vein, which led to severe complications. As a result of this incident, the little girl contracted a nosocomial infection, and her health worsened. The child’s mother noticed that the child’s foot had been considerably swollen, and the doctors later found that she had suffered permanent sequelae.
“From the forensic expert report, it turns out that the minor suffered a nosocomial infection, following the infection with E-coli, the inoculation taking place, most likely according to the expert report, starting with 15.09.2018, when the minor was administered by a medical assistant and the infusion was produced outside the blood vessel. These solutions reached in the paravan tissues at the level of the left leg have caused the tissue with inflammation/consecutive infection”, The magistrates from the Dolj Court, the substantive court that judged the case, detained.
In 2021, the girl’s mother sued the hospital and the doctor who performed the intervention. The woman asked for them to pay in solidarity five million euros. However, the expert report carried out in this case showed that the doctor did not make mistakes and against him cannot be attracted to the medical malpractice. For this reason, the magistrates rejected the mother’s request regarding the doctor’s fault.
The Dolj Court decided to grant damages of 100,000 euros. It was appealed, and the Craiova Court of Appeal increased the amount of damages for 300,000 euros. However, Craiova County Hospital, but also the mother challenged the decision, and the file became the High Court of Cassation and Justice.
The management of the medical unit claims that the responsibility for the incident belongs to the medical assistant who administered the infusion.
According to the documents in the file, the girl who currently has the age of 6 is classified as a serious disability. The little girl cannot move, has major neuro-motor delays and needs permanent supervision and help.
