The Italian state was forced to pay over 260,000 euros to a Romanian woman who was illegally deprived of her freedom for almost three years. The woman had been convicted in Italy, although she had already served her sentence in Romania for the same crimes.
The Bari Court of Appeal accepted the compensation request made by the 57-year-old Romanian woman, represented by lawyer Matteo Lazzaro, and determined that she must receive 261,760 euros for the period in which she was incarcerated and kept under house arrest.
Convicted in Italy for acts already judged in Romania
It all started in 2007, when the Trani Court sentenced her in absentia to nine years in prison. Italian investigators accused her of having an important role in a group that brought women and minors from Romania to Italy, where they were forced to practice prostitution, writes il gazettino.
The Romanian was accused of forming a criminal group for the purpose of promoting and exploiting prostitution, including minors, as well as crimes related to illegal immigration.
However, a criminal procedure had also been opened in Romania for the same acts. The woman was convicted by the Romanian courts and served her sentence, so she could not be tried again for the same case.
She was arrested without knowing that there was a conviction in Italy
About seven years ago, the Romanian woman entered Italy through the Trieste border crossing. During a routine check, the police discovered that there was a final conviction issued by the Court of Trani in her name.
The woman claims that she did not know about the existence of this decision. She was arrested and transferred to the Giudecca penitentiary in Venice.
After the incarceration, the Italian magistrates began to check whether the file in Italy concerned the same facts for which the Romanian woman had already been convicted in Romania.
Meanwhile, the Court of Appeal in Craiova had rejected the request of the Italian authorities to recognize the sentence handed down in Trani, considering that it was the same case.
The conviction was overturned
Five months after the arrest, the Court of Trani revoked the conviction based on the principle “ne bis in idem”which prohibits the trial or conviction of a person twice for the same act.
The court subsequently re-examined only certain counts, but the case continued with three appeals to the Italian Court of Cassation, which significantly prolonged the legal proceedings.
The Romanian woman was finally released only after spending 996 days in prison and another 228 days under house arrest.
Compensation of over a quarter of a million euros
After the trials ended, the woman appealed to the Court of Appeal in Bari, requesting compensation for the illegal deprivation of liberty.
The judges accepted his request and forced the Italian state to pay him 261,760 euros.
Of this amount, 234,876 euros represents the compensation for the 996 days spent in the Giudecca penitentiary, and 26,883 euros for the 228 days in which he was under house arrest.
