EU member states are required to recognize same-sex marriages legally concluded in another member state, even if national law does not allow such marriages, according to the Court of Justice of the European Union. The news caused a heated debate on the reddit platform.

The Court of Justice of the European Union (CJEU) ruled on Tuesday that EU member states are obliged to recognize same-sex marriages legally concluded in another member state, even if national legislation does not allow such marriages on their own territory. The ruling represents a direct criticism of Poland, which refused to transcribe the marriage certificate of a Polish citizen couple married in Germany in the civil registry.
The decision was taken at the request of a Polish court hearing the case of a male couple who married in Berlin in 2018 and were later refused recognition. The Court established that Poland’s refusal violates two fundamental rights of EU citizens: freedom of movement and residence on the territory of the Union; the right to respect for private and family life.
“When citizens create a family life in a host Member State, in particular through marriage, they must have the certainty that they will be able to continue this family life on their return to their home Member State”stated the CJEU, quoted by Free Europe.

All it says is that if a couple gets married in Denmark they must also be recognized in Romania, not that they will be able to marry in Romania. One platform user claims it’s the same as legalizing same-sex marriage: “Well, isn’t it practically the same thing? It’s like registering your car in Bulgaria, but driving it in the country. Broadly speaking, you get the benefits before the law with that marriage certificate, only you can’t issue it in Romanian format. So the interested population is covered, only the state loses something there with certain registration fees. And I think that there are a bunch of idiots in politics or the faces with school, with important jobs like teaching, lawyer, doctor, officer, mayor, etc., there are many idiots from these backgrounds, but not so stupid as to notice the distinction I was talking about at the beginning. And Alde Simion, especially with their false propaganda – as he said, marketing – I bet they will be the first to put straw on the fire.”
Another internet user claims that in any situation, they will be dissatisfied: “Anyway, how is the Romanian… If we recognize marriages between people of the same sex: HUUUUO! We are the slaves of Europe! We do what the EU says. If we do not recognize marriages between people of the same sex: HUUUUO! Europe is gay-iii! We are the slaves of Europe anyway!”
The Court of Justice of the European Union (CJEU) is not the “European Parliament”, it is just a kind of supranational court. They do not “give laws”, but interpret them – someone else claims.
