The unionists of the BNS demand the Government of Romania “Urgently intervenes to protect employees and prevent a massive wave of layoffs”.
The NBS specialists have performed a detailed analysis on the impact that generates the adoption of the Trenuleţ Ordinance (GEO no. 156/2024).
According to them, the main legal and practical effects of GEO no.156/2024 are:
- Violation of the principles of social dialogue and collective rights of employees in state -owned companies;
- Violation of contractual freedom and collective negotiation autonomy;
- Violation of fundamental right to fair working conditions;
- Violation of the right to work;
- Masked retroactivity;
- The outbreak of labor conflicts;
- The interference of the state in the work relations between the employer and the employee;
- Violation of the rights won;
- Massive wave of collective redundancies;
- Violation of the right to protection against abusive dissemination;
- Failure to ensure a decent standard of living for citizens;
- Violation of European law;
- The decrease of wages and the determination of a new migration phenomenon in the construction sector;
- Serious impairment of the financial stability of strategic or national interest companies.
On Tuesday, January 28, the National Trade Union Block (NBS) sent an official petition to the People’s Advocate, requesting him to notify the Constitutional Court of Romania in relation to the unconstitutionality of the Emergency Ordinance no. 156/2024.
“We consider that the normative act in question, published in the Official Gazette of Romania, Part I, no. 1334 of December 31, 2024, contains multiple violations of the provisions of the Constitution of Romania. The ordinance generates concerns about its impact on the rule of law and respecting the fundamental rights and freedoms of citizens ”BNS said.
