The section for prosecutors of the CSM resumes the vote on Monday regarding the approval of the appointment of prosecutors Marius Voineag and Alex Florentsa in management positions, after a runoff was registered at the previous meeting. On the same day, the interview of the prosecutor Viorel Cerbu, candidate for the head of the DNA, is scheduled.
The section for prosecutors of the Superior Council of the Magistracy (CSM) meets on Monday, March 16, to resume the vote regarding the approval of the appointment of prosecutors Marius Voineag and Alex Florentsa to leadership positions in the Public Ministry. The decision comes after, at the previous meeting, the vote ended in a tie, which made it impossible to issue an opinion.
According to the official portal, on the agenda of Monday’s meeting there are three important points regarding the occupation of key positions in the judicial system:
* Approval of the proposal of the Minister of Justice for the appointment to the position of chief prosecutor of the National Anticorruption Directorate
* Approval of the proposal of the Minister of Justice for the appointment to the position of deputy chief prosecutor of the Directorate for Investigation of Organized Crime and Terrorism
* Approving the proposal of the Minister of Justice for the appointment of the Deputy Prosecutor General of the Public Prosecutor’s Office attached to the High Court of Cassation and Justice.
Practically, the CSM will resume the vote in the case of Marius Voineag, the current chief prosecutor of the DNA, proposed for the position of deputy prosecutor general, and of Alex Florenta, the current prosecutor general of Romania, proposed for the position of deputy chief prosecutor at DIICOT, after at the previous meeting of the Section for prosecutors, in the case of the two, a runoff was recorded, with a score of 3 votes to 3.
According to some sources, in the case of Marius Voineag, CSM prosecutors Claudiu Sandu, Emilia Ion and Bogdan Staicu voted against the opinion, while Daniel Horodniceanu, Cătălina Sîntion and the Minister of Justice, Radu Marinescu, voted in favor of it.
According to the legislation in force, if an equal vote is recorded, the Section for Prosecutors must resume the procedure within 30 days, introducing the resumption of the vote on the agenda of each meeting. If the runoff persists after this period, the Minister of Justice can decide to send the proposal directly to the President of Romania, even in the absence of an opinion from the CSM.
Also on Monday, the Section for Prosecutors of the CSM is going to hear Viorel Cerbu, candidate for the position of chief prosecutor of the DNA.
Cristina Chiriac and Gill-Julien Grigore Iacobici received negative opinions
Within the same selection procedure, two other candidacies have already received a negative opinion from the CSM.
It is about Cristina Chiriac, proposed for the position of Prosecutor General of Romania, and Gill-Julien Grigore Iacobici, candidate for a deputy position at DIICOT, who were rejected with a score of 5 votes to 1. The only favorable vote was that of the Minister of Justice, who had proposed them for these positions.
Instead, the candidacy of prosecutor Codrin Miron for the position of chief prosecutor of DIICOT received unanimous positive approval from the Section for Prosecutors of the SCM.
We remind you that the opinion issued by the Superior Council of Magistracy is advisory in nature. The final decision regarding appointment to these management positions belongs to the President of Romania.
