The Superior Council of Magistracy (CSM) announced on Friday, June 27, that a general meeting of judges and prosecutors will be convened on June 30, during which the firm request addressed to the political factors to respect the status of judges and prosecutors will be discussed.

The SCM announces in the statement that the status of judges and prosecutors is put back in public discussion, while the real issues in the justice system are ignored.
CSM representatives point out that the measures proposed in the governance program can seriously affect the functioning of justice, stressing that the judicial authority is a power of the state and must be treated as such.
The magistrates say that they are constantly stigmatized in the public space and that the level of pay and the retirement conditions must be in line with the European standards, with the decisions of the Constitutional Court and with the realities of the work they do: high volume, high complexity, professional restrictions.
“In view of the recurrence in the public discussion of some essential aspects of the status of judges and prosecutors, ignoring the real problems of the judicial system constantly reported by the Superior Council of Magistracy and taking into account that the measures proposed by the Government Assumed by the Government of Romania will have as its sole impact the public service,
Reaffirming the constitutional status of power in the state of the judicial authority and the essential role of an independent and efficient justice in a rule of law, despite the constant stigmatization of the magistrates in the public space,
Considering that the level of salary of the magistrates and their retirement conditions must be in accordance with the European documents and the jurisprudence of the Constitutional Court, the power status of the judicial authority, the incompatibilities and prohibitions of the profession, its work volume and complexity ”transmits the SCM in the statement.
The SCM decision to convene this meeting comes after Prime Minister Ilie Bolojan announced that the special pensions reform will be a priority for the new government.
However, CSM said that “He considers that there are real and efficient solutions “,” proposed recurrent by the council “, to achieve real savings to the state budget.

To the extent that it is desired to carry out real economies to the state budget, and not only to adopt measures with media impact, but without substance, the Superior Council of Magistracy considers that there are real and efficient solutions to achieve this goal, proposed by the Council, such as:
– reorganization of the judicial activity by terminating some courts and prosecutor’s offices (at least one court/prosecutor’s office in the constituency of each court/prosecutor’s office next to the court);
– generalization of exclusively electronic communication, at least in relations with public institutions;
– accelerating the digitalization process to tend to an exclusively electronic file, at least in the cases concerning public institutions and/or professionals, with the consequence of substantial reduction of consumables (paper without paper);
– increasing stamp duties in accordance with the socio-economic reality, so that they reflect the expenses involved in solving disputes, correlated with appropriate measures to make the judicial public aid;
– adopting effective measures to recover the damages resulting from the commission of crimes ”transmits CSM in a statement.
