The government approved on Thursday, June 13, 2024, by decision, the mutual recognition between Romania and the United States of the working periods and the right to pension between the citizens of the two states.

The Ministry of Labor and Social Solidarity announced that “The executive approved the way of applying the Agreement in the field of social security concluded with the United States of America, a document that regulates the mutual recognition of insurance periods and the right to pension in the two countries.”
According to the cited source, the social security agreement and its administrative arrangement apply to persons who are or have been subject to the laws of one or both states, but also to those whose rights derive, according to the applicable laws, from them.
“For Romania, the Agreement applies to the laws that regulate pensions and death benefits from the public pension system, as well as to the laws that regulate social health insurance contributions. Thus, it will be possible to capitalize on the periods worked both in Romania and in the USA, in order to open the pension right on the principle of totalization, with the proportional granting of the pension by each state, depending on the insurance periods completed in its own system”the Ministry of Labor sent.
Another important aspect refers to the export of pensions, respectively to “facilitating the mobility of pensioners from the two states on the territory of the other state and maintaining their access to pension rights in payment”.
The Agreement also contains provisions to avoid doubling a worker's social security contribution or the risk of not being subject to any social security scheme covered by the Agreement.
As for posted workers, they will be mutually exempt from paying social health insurance contributions from the national system of the state where they are posted.
“The document will enter into force on the first day of the fourth month from the date of the last Note in which the states notify each other through diplomatic channels of the completion of the internal procedures necessary for entry into force”also specified Mihai Constantin, the spokesperson of the Executive.
