The BEC rejected the AUR’s appeals regarding the establishment of the electoral offices of the sections abroad. Simion: “I am a widower”

The Central Electoral Office for the election of the President of Romania rejected, on Thursday, the appeals of the AUR against the decision of the Electoral Office no. 48 regarding the establishment of the composition of the electoral offices of the polling stations abroad, as a result of which this party will not have representatives in the stations.

AUR claimed, in the appeal, that the decision of the Electoral Office no. 48 regarding the drawing of lots of these representatives is “illegal and groundless“, according to Agerpres.

According to the AUR, the decision of the Electoral Office no. 48 does not respect the principles provided by Law no. 370/2004 for the election of the President of Romania, which regulates the procedure for the establishment and completion of the electoral offices of the polling stations in the country, in two stages, the first being the designation of the representatives of the parliamentary parties, following which the drawing of lots will be used only for the other participating formations with election candidates.

“By the general application of the drawing of lots method for all political formations, regardless of their parliamentary or non-parliamentary status, BESV no. 48 created an inequity between the manner of constitution/filling of polling station offices in the country and those abroad, invoking the jurisprudence of the Constitutional Court, according to which the principle of equality requires equal treatment for identical or comparable situations“, AUR showed.

And the drawing of lots procedure was challenged by the AUR, which claimed that it was not carried out in the presence of all the members of the office and the candidates or the persons delegated by the leaders of the political formations that proposed candidates.

AUR’s appeals were rejected as “unfounded”, The Central Electoral Office noting that, by art. 23 of Law no. 370/2004, special rules are established for the establishment and completion of the electoral offices of the polling stations abroad, the completion being done in a single stage from among the representatives proposed by the political formations participating in the elections, unlike the other electoral offices, where the completion is done in two stages.

According to art. 23 of Law no. 370/2004 for the election of the President of Romania, the electoral offices of the polling stations abroad are made up of 9 members, of which a president, a deputy and at most 7 members proposed by the political formations participating in the elections, states the BEC.

AUR is in position 9, while these offices need to be filled with seven members.

Electoral Office no. 48 for the Voting Precincts from Abroad established, on October 21, by drawing lots, the order of filling the electoral offices of the voting precincts abroad with the representatives of the political formations that proposed candidacies that remained definitive, and, according to the decision, the AUR is in position 9, while these offices need to be filled with seven members.

Thus, the order of completion of electoral offices for polling stations abroad is as follows:

Position 1 – Social Democratic Party;

Position 2 – Hungarian Democratic Union from Romania

Position 3 – Save Romania Union

Position 4 – National Action League Party

Position 5 Alternative for National Dignity

Position 6 – The Force of Right

Position 7 – Romanian National Conservative Party

Position 8 – National Liberal Party

Position 9 – Alliance for the Union of Romanians

Position 10 – New Romania Party.
