The Constitutional Court of Romania is debating, on Monday, October 20, the referrals submitted by the AUR, SOS and POT parties against the Law regarding the establishment of measures for the recovery and efficiency of public resources and for the modification and completion of some normative acts.

The measures are part of package II for which the Bolojan Government assumed responsibility.
The AUR argued in the notifications sent to the Constitutional Court that the projects were adopted “without a parliamentary debate, without consulting the Romanians and without a democratic vote”.
“Through this maneuver, the executive power seized the role of the Parliament and trampled on the fundamental principles of the rule of law. The analysis of the projects adopted through this abusive procedure shows an alarming picture: constitutional violations of exceptional gravity, a systematic attack on the separation of powers in the state and a deliberate attempt to concentrate legislative power in the hands of the Government. The invocation of ’emergency’ to justify the exceptional procedure is a institutional lie”it is stated in a press release from the AUR.
“Pretext to bypass Parliament”
The Alliance for the Union of Romanians also claims that “problems such as the excessive budget deficit or the health crisis did not appear overnight”:
“They date back to years when successive governments refused to act democratically. Artificially creating an emergency and using it as a pretext to bypass Parliament is a constitutional fraud and a breach of the principle of good faithit is”.
We remind you that, also on Monday, the Constitutional Court of Romania is also discussing the referral submitted by the High Court of Cassation of Justice in relation to the law on the pensions of magistrates, for which the Government pledged its responsibility in Parliament.
The CCR twice postponed taking a decision in this case – on September 24 and October 8. At the beginning of September, the United Sections of the High Court of Cassation of Justice decided to refer the Constitutional Court of Romania in relation to the law on the service pensions of magistrates.
