The draft Emergency Ordinance on the non-taxation of pensions under 3000 lei, announced by Prime Minister Marcel Ciolacu, has unconstitutionality, claims the Minister of Justice, Alina Gorghiu. At the same time, the Coalition also agreed to the adoption by Emergency Ordinance of a package of measures, which provides, among other things, the updating of the ceilings on the beneficiaries, as a result of the pension increase for a large majority of pensioners. There are currently two types of updates being discussed, there may be others:

1. Food vouchers of 250 lei paid every 2 months, 2.4 million beneficiaries;

2. Energy card: 1,400 lei twice a year, 1.1 million households.

The warning of the Minister of Justice

Alina Gorghiu warned today in the framework of the National Political Bureau (BPN) that “the draft GEO regarding the non-taxation of pensions under 3000 lei has defects of unconstitutionality. It’s about article 115 of the Constitution: we have no arguments to urgently pass something like this, the liberal project in Parliament must be voted on. Not because it is liberal, but because it is the right way to regulate. Simply put: the situation considered by the government cannot be qualified as an extraordinary one, as the Constitution requires, and the existence of an emergency in the adoption of the regulation cannot be claimed either.the minister showed according to some sources Adevărul.

For her part, Raluca Turcan declared that “We have two decisions of the CCR that say that you cannot change the legislation regarding pensions and salaries through GEO if there is a project in the legislative circuit. I believe that in a spirit of minimum solidarity we can strengthen the legislative role and vote on this project“.

In response, Nicolae Ciucă said that “this will be the first project discussed in today’s Coalition meeting, we will support promoting it through Parliament”.
