The government approved the draft law on the amendment and completion of Law no. 158/2019 for the establishment of measures to implement the Agreement between the Government of Romania and the Government of the United States of America regarding the intensification of cooperation in the prevention and combating of serious crimes, signed on October 5, 2015 in Washington DC, as well as for the modification of some normative acts, according to a press release from the Executive, quoted by Agerpres.
“Thus, the aim is to create an automated workflow in terms of collaboration with the Department of Homeland Security, which would allow the national contact point(s) designated by the American side and the Romanian side to automatically search for dactyloscopic reference data in the national AFIS system through the computer platform, as well as in similar identification systems of the American side, as well as the transmission, as appropriate, of personal data and additional information, in case of a match. In this sense, the General Inspectorate of the Romanian Police, the General Inspectorate of the Border Police and the General Inspectorate for Immigration are designated national contact points for conducting automated inquiries for the purpose of preventing, discovering and combating serious crimes in terms of collaboration with the Department of Internal Security“, the statement says.
At the same time, the draft law creates the possibility that the mechanism and conditions for carrying out the exchange of information for the provision of personal data and other additional information in relation to the reference data will be established through implementation arrangements concluded at the level of the Ministry of Internal Affairs and The Romanian Intelligence Service with the national contact point(s) designated by the American side.
Also, comprehensive provisions regarding the protection of personal data processing are included.
