The initiative appeared after a decision of the High Court of Cassation and Justice by which the shirts minimized their losses, because the JCCJ interpreted that the money given by them does not constitute the good/object of the crime, and the state can only confiscate the interest obtained, writes Agerpres.
“If you do a house, you go without money to prison! It is time to take the money from the housekeepers and to correct a big mistake made by the JCCJ. It is ridiculous not to be confiscated the amount that is given with the title of camp when a servant is convicted for this crime. It is ridiculous because this amount is the subject of the crime. We must stop these practices, because it generates trafficking in people, poverty and other crimes ”says USR deputy Alexandru Dimitriu, a member of the Legal Commission in the Chamber of Deputies, and the one who initiated the project, along with the deputy Stelian Ion.
“After the entry into force of the USR law, those who enrich themselves from the cams will not be able to keep any lion of the amounts used to commit the crime. The traders will thus be discouraged to make more offenses, because they risk losing all the money.
Romania needs clear and firm laws against the house, not portions to protect the criminals. Only in this way can we truly discourage this toxic practice, who exploit people in situations of vulnerability, ”says deputy Stelian Ion, former Minister of Justice.
According to the ICCJ Decision no. 26/2025, in the case of the crime of cama only the interest is subject to the special confiscation regulated by art. 112 of the Criminal Code. This meant that the state could confiscate from the shirts only the money obtained as interest, not the money borrowed.
The USR law amends art. 351 of the Criminal Code as follows: “The giving of money with interest, as a task, by an unauthorized person, is punished with imprisonment from 6 months to 5 years. The special confiscation bears both the amount of money given and on the interest obtained by committing the crime, including when it is included in the amounts later and according to art.
