In the updated list of the Classification of Activities in the National Economy (CAEN), valid from January 1, 2025, a new CAEN code (9699) appears where the occupations of providing sexual services and prostitution are entered.

Specifically, in the updated list of the Classification of Activities in the National Economy (CAEN) new jobs appear:
– astrological and spiritual activities, social activities (eg escort services, dating services, services of a marriage bureau) – All under CAEN Code 9699
– providing or arranging sexual services, organizing prostitution events or operating prostitution establishments
– pet services (e.g. accommodation, care or training for animals)
– operation of shelters for abandoned pets
– genealogical organizations
– the activities of tattoo and piercing studios
– the activities of ironing shoes, years, parking, etc
– concession operation of coin-operated personal service machines (for example, photo booths, scales or lockers)
– operation of photo machines for printing photos from electronic records (eg from phone, memory cards, flash drives)
– meetings and other speed networking activities
– the activities of the tattoo artist, using biological substances (for example, henna) for temporary decoration
– horse whispering activities – housekeeping activities – wedding planner activities

According to the Criminal Code of 2014, prostitution became a misdemeanor instead of a crime, being sanctioned with a fine.
What the Ministry of Justice says
Theoretically, the list of the Classification of Activities in the National Economy (CAEN) is updated and drawn up by the Ministry of Justice, in collaboration with the National Office of the Trade Registry, but officials from the Ministry of Justice say otherwise: “Considering the requests received from media representatives regarding the updating of the Classification of Activities in the National Economy, we specify that the activities codified in Romania are those strictly provided by the legislation in force. In this sense, activities not allowed by national legislation cannot fall within the scope of those codified in Romania. We specify that the updating of CAEN classes was not done by the Ministry of Justice or ONRC, but is approved by the order of the President of the National Institute of Statistics no. 377/17.04.2024 regarding the updating of the Classification of Activities in the National Economy – CAEN“, stated the Ministry of Justice.
