The regulation on the organization and operation of pre-university education units (ROFUIP) and the Student Statute were released for public consultation. The Ministry of Education proposes two extremely important documents for debate, especially since they come with several changes, some of them controversial and which have already caused a stir among parents.

Regulation on the organization and operation of pre-university education units, the most important changes
The regulation on the organization and operation of pre-university education units, the main provisions of the regulation refer to:
- maintaining the possibility of suspending courses with physical presence in exceptional situations, with the clear introduction of the provision according to which, in these situations, the activity can be carried out in online or hybrid format;
- the introduction of the possibility that the meetings of the board of directors/teachers' council can be held in a hybrid or online format, without conditioning on the existence of exceptional situations;
- introducing the possibility that, depending on the existing resources at the level of the educational unit, managerial documents, as well as other documents developed by the commissions established at the level of the educational unit, be stored in digital format.
- the introduction of the provision according to which, at the end of each course interval/learning module, a mark/characteristic is given for behavior, through which the student's behavior is evaluated, as well as his compliance with the regulations adopted by the educational institution;
- The performance average obtained at the end of the school year as the average of the grades awarded for each learning interval is reduced accordingly, in the case of students who registered a number of unmotivated absences, according to the provisions in force.
- the introduction of the prohibition for pre-university teaching staff to carry out additional training activities for a fee with students from the classes to which they belong;
- the introduction of the provision according to which pre-university education units and extracurricular education units will publish on their own websites and through any other form of public communication that they have the fire safety authorization, as well as the sanitary operation authorization or, if these authorizations are not held by the school, they will inform in this sense.
- the introduction of the provision by which, in order to ensure the connection of the children's parents with the educational unit, at the level of the educational unit, a flexible schedule of the Secretariat compartment will be decided, so as to ensure communication with the parents in the time interval 8.00-9.00, respectively 16.00-18.00 , at least two days a week.
- More support for school/career guidance by introducing the provision according to which, upon completion of secondary and high school education, the school counselor teacher and the principals will issue, for each student, a recommendation for placement in a form of higher education, having character of school orientation and, in the case of high school graduates, the possibility of issuing a recommendation in the form of a vocational orientation for employment on the labor market. The recommendations are advisory.
Parents may also be required to comply with the school's organizational and operating regulations,
Art. 2 -“(9) Compliance with the provisions of the regulation on the organization and operation of the educational unit by teaching staff, auxiliary teaching staff, administrative staff, students and parents is mandatory. Non-compliance with the organization and operation regulations of the educational unit constitutes a violation and is sanctioned according to the legal provisions.”

Art. 2 – (12) The internal order regulation is made known to the public, through its own websites, in a special section, and through any other form of public communication existing at the level of the school unit.
Student status, news: student expulsion
Mobile phones. Among the most important provisions contained in the Student Statute are: the maintenance of the ban on the use by students of mobile phones or other electronic communication equipment during class hours, except for their use for educational purposes, with the consent of the teaching staff. Failure to comply with the aforementioned prohibition may lead to the equipment being taken over by the educational unit staff, with a view to its return at the end of the course hours of the respective day, mandatorily, to parents or adult students, as the case may be, according to the internal regulations of the educational unit. The provisions do not apply to equipment that students with SEN are authorized to use.
Decreasing the wear grade. The project introduces the provision according to which, for secondary and high school students, every 40 unexcused absences per school year from the total number of study hours or 20% unjustified absences from the number of hours per school year in a study discipline/specialist module , the annual wearing average will be reduced by one point.
The following sanctions are introduced in the student status:
- individual observation;
- written reprimand;
- the temporary withdrawal or for the duration of the entire school year of the scholarships that the student benefits from;
- disciplinary transfer to a parallel class in the same educational unit;
- suspending the student for a limited period of time, according to the law;
- notice of exmatriculation;
- expulsion with the right to re-enroll in the following school year in the same educational unit, according to the law;
- expulsion with the right to re-enroll in the following school year in another educational institution, according to the law;
- expulsion without the right to re-enroll for post-secondary education students.
Students sanctioned with suspension, notice of expulsion or expulsion with the right to re-enroll benefit from school counseling, psychological intervention and psychotherapy, as well as remedial activities.
The students' right to challenge the sanctions was maintained. In the situation where, as a result of the settlement of the appeal which was also accompanied by the lowering of the performance grade, the sanction is modified or cancelled, the decision to lower the performance grade can be modified or cancelled.
News for kindergartens and nurseries
In kindergarten and nursery school, the children's schedule cannot exceed 10 hours a day. Kindergartens with a normal schedule have 5 hours of activity with the children, and those with an extended schedule – 10 hours of activity per day with the children.
