The PNL project regarding the candidacy of the President of Romania in the parliamentary elections has been postponed. Fenechiu: “We are not changing the Constitution”

Daniel Fenechiu claimed that he requested that the PNL project regarding the candidacy of the President of Romania in the parliamentary elections be submitted to the Judiciary Commission in a week, in order to give the institutions the opportunity to clarify whether it is necessary to amend the law.

The Central Electoral Bureau (BEC) and the Permanent Electoral Authority (AEP) will clarify this situation.

At my request, the deadline for the report was set next week, Monday, considering the fact that the National Liberal Party addressed the Central Electoral Bureau and the Permanent Electoral Authority with a request to clarify the necessity or non-necessity of amending the law for the purpose pursued by the law, namely the participation the president at the end of the term of office at the parliamentary elections (…). We technically preserved the prospect of the project moving forward. We requested an emergency procedure, it will be on the order of the Legal Commission on Monday, assuming we do not change this decision, in relation to why BEC and AEP, if we receive answers from there and the political decision will be different, then we respect the political decision“, stated Daniel Fenechiu, the leader of the liberal parliamentary group in the Senate, according to Agerpres.

He added that the PNL does not intend to amend the Constitution to give the president the opportunity to run for parliament, emphasizing that in fact a solution that was validated by the CCR in 2004 is being resumed.

We do not modify the Constitution, we respect the Constitution and we are resuming a solution that was validated by the Constitutional Court in 2004. I saw Mr. Zegrean saying that (…) is unconstitutional. In 2004, Mr. Zegrean was at the Constitutional Court, yes? Has the Constitution been amended? The text is the same, I used the same text specifically to not allow fishing in murky waters. I mean, the text is identical to the one from then, the Constitution is the same. So, for the same reason, for the same identity, the solution cannot be different“, the liberal senator claimed.

Fenechiu added that the reason why the PNL gave this legislative project is the fact that only politically assumed persons can run on a party’s list, and the president cannot make a statement in this sense because he is independent, according to the Constitution, and could not run .

Due to the independence of the president and due to the legal provisions, only politically assumed persons can run on the lists of candidates. When you submit your candidacy, you give a statement that you are a member of the party and that you accept the candidacy. An independent, in this case the president, cannot make such a statement. Unable to give a declaration required by law, he could not run. He has his independence because the Constitution obliges him“, explained the senator.

The PSD voted against the bill

The social democrats voted unanimously, in the BPN meeting, against the draft law proposed by the PNL that allowed President Klaus Iohannis to run in the parliamentary elections.

We make a decision. If we wanted to continue certain stuttering, that we leave it to the parliamentarians, now we have a decision, I don’t know if we also have a normative act. This law is not a priority neither for me, nor for the government, nor for the PSD. I told you my opinion. I don’t care“, said Marcel Ciolacu, on Monday, upon leaving the PSD headquarters.

Asked if the liberals would have proposed this change to him a year ago, the PSD leader replied: “We had no such discussion. It means they are lying, they didn’t have such a discussion with me“.
