The student allegedly wrote the notes incorrectly in the music class, at which point the teacher put a 1 in the catalog. The parents asked for the grade to be re-evaluated, arguing that a grade of one is usually given when the student copies. Although the Iași School Inspectorate carried out an evaluation, the grade was maintained in the catalog.
The parents, who work in the justice system, went further by addressing the court. The Magistrates of the Court of Vaslui appreciated that a student cannot be penalized for knowledge they acquired in other years, in the context in which they learned to write notes in the pen in the previous year.
Following the trial, the grade was cancelled, but the decision is not final. Although there are several students from the National College of Iași who were penalized for a similar mistake, only the child whose parents went to court had his grade canceled.
According to the Student Statute of 2024, the student, represented by the parents, can challenge the grade received in the written assessment within 5 days of its communication, according to the Education Portal.
“a) the student or, as the case may be, the parent/legal representative verbally requests the teaching staff to justify the evaluation result, in the presence of the student and the parent/legal representative, within a maximum of 5 working days from the communication;”it is specified in the Student Statute.
If the teacher’s arguments regarding the grade are not satisfactory, the student, together with the parents, can submit a written request to the school management. Thus, the director, together with two other specialized teachers who do not teach in the respective class, reevaluate the work.
If there are not enough teachers in the school, the principal can ask the school inspectorate to bring some teachers to evaluate the work.
