Women who have given birth or raised one or more children can benefit from the reduction of the standard retirement age, if they meet the conditions provided by law. The law establishes the reduction according to the number of children raised.
The facility is regulated by Law no. 360/2023 on the public pension system and is granted according to the number of children raised up to the age of 16, including in certain adoption situations.
An essential criterion for granting this right is the completion of the full contributory contribution period.
Who can benefit from the retirement age reduction?
According to art. 51 of Law no. 360/2023, women can retire earlier if they simultaneously meet two conditions:
– have completed the full contributory contribution period provided for by law;
– have given birth to and raised one or more children up to the age of 16.
Women who have adopted children benefit from the same facility, provided that they have raised them to at least 13 years of age.
The reduction is a distinct right from other situations where the standard retirement age can be reduced.
As the retirement age is reduced
The law establishes the reduction depending on the number of children raised:
1 child – 6 months discount;
2 children – 1 year discount;
3 children – discount of 1 year and 6 months;
4 children – 2 years discount;
5 children – discount of 2 years and 6 months;
6 children – discount of 3 years;
7 or more children – 3 years and 6 months discount.
What documents are required?
In order to benefit from the reduction of the retirement age, the applicant must submit documents proving the fulfillment of the legal conditions.
In the case of biological children, the following are required:
– birth certificates of children;
– an affidavit stating that they have been raised up to the age of 16.
In the case of adoption, the following must be submitted:
– the final court decision approving the adoption;
– the child’s birth certificate;
– an affidavit certifying that he has been raised for at least 13 years.
The discount can be combined with other facilities
The law allows this reduction to be cumulated with other reductions of the standard retirement age provided by the legislation in force, including those granted for the activity carried out in special or special working conditions or in other situations regulated by special normative acts.
However, the total reduction of the standard retirement age cannot exceed 11 years.
What is the standard retirement age?
According to Law no. 360/2023, the standard retirement age is 65 for both women and men.
In the case of women, reaching this age is done in stages, according to the calendar provided in Annex no. 5 of the law.
The minimum contribution period required to obtain the old-age pension is 15 years, and the full contribution period is 35 years for both sexes. For women, reaching full seniority is also achieved gradually, according to legal provisions.
