The Ministry of Labour, Family, Youth and Social Solidarity (MMFTSS) announces that it reserves the right to file an appeal against the decision of the Bucharest Court of Appeal regarding the future salary law, arguing that the institution was not cited as a defendant and did not have the opportunity to present its defense.
According to the ministry, the case from file no. 4655/2/2026 was resolved on the same day of registration.
“The case was settled on the day the file was registered, without citing the ministry as a defendant, which made it impossible to present it before the court and exercise the right to defense“, MMFTSS transmitted.
The Ministry specifies that the future salary law represents an important milestone in the National Recovery and Resilience Plan (PNRR), for which a penalty of 770 million euros is foreseen.
The ministry claims that it was preparing a document for a parliamentary initiative
The institution states that the steps taken so far aimed at organizing a consultation process with unions, representatives of institutions and public authorities and other relevant actors.
In the context in which the Government exercises its powers with limited powers, the ministry claims that the intention was to draw up a document by the institution’s specialists, which could be the basis of a parliamentary initiative undertaken by pro-European political actors.
According to MMFTSS, it was not about a draft law that would go through the procedural stages necessary for adoption by the Government, such as decisional transparency, social dialogue commissions, interministerial approval and adoption in the Executive session.
The Ministry shows that, as the coordinator of the milestone in the PNRR regarding the remuneration of staff paid from public funds, it sought to provide technical and methodological support for the foundation of the future reform.
“The suspension ordered by the court concerns the formal procedure of initiation, promotion and adoption of the draft normative act and not the exercise of the legal powers of the ministry in the matter of social dialogue“, states the institution.
Consultations would continue
The Ministry of Labor considers that it can continue the consultations with the social partners, as long as they are not followed by the procedures of initiation, promotion and adoption of a draft law.
According to the institution, consultations, technical debates and meetings with social partners represent activities of analysis and substantiation and do not lead, by themselves, to the promotion of a normative act.
“We appreciate that Decision no. 1282/21.07.2026 does not prevent the Ministry of Labor from exercising its legal prerogatives to carry out social dialogue activities, in the conditions where there is no intention to initiate, promote and adopt a draft normative act, but only to substantiate the debate of political parties or the initiative of members of Parliament“, the press release states.
The Ministry reserves the right to file an appeal within five days of the notification of the decision, citing non-compliance with the subpoena procedure and the impossibility of formulating defenses before the court.
