A doctor was allegedly fined 20,000 lei by the National Consumer Protection Authority (ANPC) after publishing a video explaining why some magnesium supplements leave a sand-like sensation after dissolving. The case will also come to the attention of the European Commission, after a member of the European Parliament announced that he would request clarifications.
In the video for which she would have been sanctioned, Dr. Ioana tested four soluble magnesium products that had different concentrations of pure magnesium. The test would have suggested that the products also contained insoluble forms of magnesium, although only a soluble form was indicated on the label.
This would explain, according to the material produced by the doctor, the cloudy water and the “sandy” feeling left by some of the supplements.
The doctor would not have presented the names of the products, nor would he have provided other elements by which they could be recognized. It would also have stated that the products are safe but have different properties, requiring the authorities to carry out laboratory tests to verify that the information on the labels corresponds to the actual composition.
The fine would have been imposed under the Unfair Commercial Practices Act
According to the information presented by the MEP, the 20,000 lei sanction would have been applied based on Law no. 363/2007 on combating unfair practices of traders in the relationship with consumers.
The MEP announces that he will address a parliamentary question to the European Commission and request a written answer regarding the application of European legislation in this case.
Specifically, he wants to know whether European law allows informational material produced by a healthcare professional, which does not identify products and does not promote or sell anything, to be sanctioned as unfair commercial practice.
Explanations also requested from ANPC
The MEP announced that he would also request explanations from the ANPC regarding the concrete fact that was considered an unfair practice and how consumers would have been harmed.
He also wants to know why the doctor was considered a “trader”, if the analyzed products were tested by the authorities and if the information written on their labels corresponds to their composition.
“It is in everyone’s best interest to look critically at the products we consume, especially supplements and medications. The desire to inform without panicking should not be punished. It should prompt authorities to check products, labels and information provided to consumers“, the MEP sent.
