A partition trial brought before the court an unusual request: a man asked that his ex-wife’s breast implant be taken into account when dividing assets.
When two people get divorced, most disputes over division involve houses, apartments, cars, savings or other assets bought during the marriage.
An atypical case came before the court in Romania, after a man requested that his ex-wife’s breast implant be taken into account in the division. The ex-husband claimed that he paid for the medical intervention while the two were married and wanted to recover part of the invested amount.
The story was made public by the lawyer Constantin Neacșu, who presented on his TikTok account one of the most unusual sharing files he encountered.
“Today we got a ruling in a civil sharing case so memorable that I think civil law should get an Oscar for comedy every now and then. Because it’s not every day that an ex-husband asks, in the utmost seriousness, to share his ex-wife’s breast implant.” the lawyer said on his TikTok account.
The lawyer explained that the request was not for the man to actually receive the implant, but for the value of the intervention to be recognized as an expense that should be shared between the former spouses.
The court did not accept the request, the judge finding that the implant cannot be treated as ordinary property that can be valued, divided or claimed after the divorce. Even if the man claimed to have borne the costs of the intervention, the expense was considered one related to the person of the ex-wife, not an element of the joint patrimony.
“Yes, you heard right. The man basically wanted to be recognized for half of the investment. Only the court took over my conclusions: the human body is inviolable, it is not in the civil circuit, it is not a shareable good. We cannot put the prosthesis on the court table like a television. The expense is consumed like a treatment, like a massage, like a hair removal. That’s it, it’s gone.
Despite the fact that the plaintiff, the ex-husband, adamantly claimed in his reply that he had paid for the entire procedure, when I read his arguments, I realized that life beats the movie, and the movie beats any law textbook.” Constantin Neacșu also said.
The lawyer explained that the court applied the principle according to which certain elements belonging to a person’s body cannot become assets subject to division between former partners.
“As I was saying, the court, calmly, with that air of I can’t believe we’re discussing this, held exactly what the law says: the implant is strictly personal property, part of the person’s body. It cannot be divided, valued, claimed, removed, moved, transferred, amortized or auctioned. And so closed one of the most uplifting cases of my career as a lawyer.” stated Constantin Neacșu.
