Pepe has definitively lost a copyright lawsuit. Prescription found by magistrates

The artist Pepe lost in court a lawsuit he had with a well-known commercial company from Iasi, regarding a copyright contract.

The judges of the Iași Court rejected his request in court against the Roton company, through which the artist demanded the termination of the contract of assignment and the payment of compensations related to copyrights.

The magistrates partially accepted the prescription exception invoked by the singer Ionuț Nicolae Pascu, known as Pepe. They determined that his right to complain about the termination of the 2004 contract was time-barred, given the culpable non-performance of contractual obligations prior to November 26, 2018.

Initially, the file had been submitted to the Bucharest Court, but it was transferred to the Iași magistrates. The artist hoped that they would prove him right, and that the company would be obliged to pay him compensation. But the court’s decision did not align with his expectations.

“The court partially admits the exception of the limitation of the material right to action invoked by the defendant, by counterclaim, and, by way of consequence, finds that the plaintiff’s material right to action to request the termination of the Assignment and Publishing Contract no. 430/20.12.2004 based on possible acts of culpable non-execution of contractual obligations prior to 26.11.2018. Rejects the action filed by the plaintiff Pascu Ionut Nicolae in opposition to the defendant Roton SRL, having as its object the termination of the Assignment and Publishing Contract no. 430/20.12.2004, for the intervention of the prescription of the material right to action (on the basis of possible acts of culpable non-execution of contractual obligations prior to 26.11.2018) and otherwise, as unfounded”the Iași magistrates sent.
