The political conflict on the subject of the new Law of the National Integrity Agency (ANI) continues, after USR senators, along with eight PNL senators, referred the new law to the Constitutional Court, and PSD accuses the two parties of risking blocking hundreds of millions of euros from European funds intended for Romania.
USR announces that it has appealed to the Constitutional Court two amendments introduced into the law, which it claims raise serious constitutional issues and may affect the fulfillment of the milestones of the National Recovery and Resilience Plan (PNRR). The formation states that the approach aims to obtain a guarantee that the new law respects the Constitution and will be accepted by the European Commission.
According to the USR, one of the disputed articles provides for the sanctioning of the loss of office or mandate of persons in incompatibility or conflict of interests before the entry into force of the new law, an aspect that the party considers a retroactive application of the law.
Also, USR contests the provision that compels the submission of declarations of assets and interests and persons who have “relationships similar to those between spouses” with dignitaries, appreciating that the wording is unclear and may violate constitutional rights.
“PSD and AUR tried to use the umbrella of the PNRR bars to attack their political opponents through patently unconstitutional amendments. (…) If we want to access all the PNRR money, we need a law that respects the Romanian Constitution, CJEU decisions and the principles of the rule of law”, said the leader of USR deputies, Diana Stoica.
For his part, the leader of the USR senators, Sorin Șipoș, claims that the notification concerns the articles introduced by PSD and AUR, which he says are aimed at the USR leader, Dominic Fritz, and Mirabela Grădinaru, the partner of President Nicușor Dan.

In a statement, the social democrats state that the referral to the Constitutional Court “blocks 771 million euros from the funds intended for Romania”, accusing the two parties of trying to protect USR leader Dominic Fritz.
“For years, USR and PNL have demanded zero tolerance when it comes to integrity. They have built political careers saying that no one is above the law and that final decisions must be respected. Today, when the rules concern their own leaders, the same principle seems negotiable. Integrity is no longer presented as a value, but as a problem to be solved.” submitted PSD.
The PSD claims that the amendment regarding the transitional norm does not produce retroactive effects and that it only provides that the persons definitively sanctioned before the entry into force of the new law shall fully execute their sanctions applied on the basis of the old legislation. According to the social democrats, the amendment applies to all persons in incompatibility or conflict of interests, not just to a particular case.
The social democrats consider that the notification of the USR to the CCR does not have a constitutional foundation, but represents “a desperate attempt” to avoid the application of the sanctions provided by law, even at the risk of losing European funds.
