President Klaus Iohannis promulgated, on Monday, the additions to the Law on the adoption procedure related to the continuity of the adopters' stay in Romania.

According to the new provisions, the law addresses “to Romanian citizens or Romanian citizens with multiple citizenships, as the case may be, who are domiciled in Romania, who have effectively and continuously lived on the territory of Romania in the last six months prior to the submission of the attestation request”, stipulating that interruptions due to employment contracts that require staying on the territory of other states cannot be considered interruptions.
“When establishing continuity, temporary absences that do not exceed three months, absences determined by carrying out activities specific to the maritime sector based on seafarers' employment contracts, absences determined by staying on the territory of another state as a result of the existence of employment contracts, and neither those imposed by the performance of some activities carried out in the interest of the Romanian state or as a result of some international obligations assumed by Romania”, the amendment of the law shows.
The amendment was adopted by the Parliament at the end of March, one year after the favorable vote of the Senate.
“The fluidization of the process is not achievable if measures are not taken to favor the increase in the number of adoptive parents in the country”, the AUR senators and deputies show in the justification of the project.
It is also noted that “the time spent in the protection system must be substantially reduced”.
“In its current form, the text is clearly discriminatory for Romanian citizens residing in Romania who, in order to carry out activities specific to the labor sector, are temporarily absent from the country for a period equal to the absences of Romanian citizens who carry out activities outside the territory of Romania, in the interest of the Romanian state or as a result of some international obligations assumed by Romania”the initiators also motivated, claiming that “thus, in order to stimulate, support and encourage national adoption, it is necessary to remove any form of discrimination that can gravitate around the adoption process and that would harm, first of all, children”.
