The government approved, on Friday, the Law on establishing European minimum wages. The draft law is to be submitted for adoption by the Parliament as an emergency.

“The Government approved the Law on the establishment of European minimum wages, which ensures the transposition into national legislation of Directive (EU) 2022/2041 of October 19, 2022 of the European Parliament and of the Council on adequate minimum wages in the European Union”, the Ministry of Labor and Social Solidarity announced on Friday, emphasizing that the draft law is to be submitted to the Parliament for emergency adoption.
The European minimum wage is also provided for in the National Recovery and Resilience Plan, Milestone 392, according to which the gross minimum wage per country guaranteed in payment will be established based on an objective mechanism based on a clear formula, in consultation with the social partners .
What the draft normative act provides
The Minister of Labor and Social Solidarity explained that the minimum gross salary per country guaranteed in payment will be updated annually.
“The gross minimum wage per country guaranteed in payment will be updated annually according to purchasing power, the general level of wages and their distribution, the rate of wage growth and labor productivity at the national level. The adequacy of this minimum income requires that the salary is not less than 50% of the average gross salary earnings. In addition, the draft law involves strengthening the role of trade unions and employers“, declared the Minister of Labour, Simona Bucura-Oprescu.
It is also provided that Directive (EU) 2022/2041 will apply to all categories of employees, regardless of whether they carry out their activity on the basis of an employment relationship, employment relationship of a special nature (mandate contract, management contract, contract of sports activity, etc.) or service report.
The draft normative act also provides for the adoption of an action plan to promote collective negotiations, to increase employees’ access to collectively negotiated salary rights and to cover protection through collective labor contracts or collective labor agreements.
According to the quoted source, it is also foreseen to penalize non-compliance with the provisions regarding the guaranteed payment of the gross minimum basic salary per country guaranteed in payment, established by normative act or the minimum wage level established by the applicable collective labor agreement, with a fine from 3,000 lei to 5,000 lei for each person who was not guaranteed the minimum gross salary
