The Supreme Court rejected Mircea Geoană’s request to appoint a representative in the BEC, but admitted the referral to the Constitutional Court regarding some articles of Law 370/2004.

On Tuesday, the Supreme Court rejected an appeal filed by Mircea Geoană, an independent candidate in the presidential elections, in which he requested the annulment of a decision of the Central Electoral Bureau by which his request to have a representative in the BEC was refused, according to agerpres.
On October 11, Mircea Geoană proposed the appointment of a representative within the BEC, but his request was rejected two days later. The Central Electoral Bureau maintains that the provisions of Law 370/2004 for the election of the President of Romania do not grant independent candidates the possibility of appointing a representative in the BEC, but only the parliamentary and non-parliamentary parties that proposed candidates.
Mircea Geoană appealed the BEC’s decision in court, but his appeal was rejected. On the other hand, the Supreme Court admitted a request by Geoana regarding the referral to the Constitutional Court with the exception of the unconstitutionality of the provisions of several articles of Law no. 370/2004, provisions that refer to the manner of setting up the Central Electoral Bureau and the county electoral bureaus.
