The file in which Călin Georgescu is accused of promoting legionary and fascist ideas remains in the preliminary chamber, after two judges of the Bucharest Court failed to agree on whether the trial can begin on the merits or must be sent back to the Prosecutor’s Office.
Two judges from the full Bucharest Court, which is dealing with the legionary propaganda file of Călin Georgescu, did not reach a common solution on Friday. The magistrates had different opinions regarding the start of the trial on the merits or the resending of the case to the Prosecutor’s Office for the resumption of the criminal investigation.
The trial is in the preliminary chamber, and on December 9, 2025, the 1st District Court decided that the trial on the merits can begin, after finding that the evidence administered by the prosecutors is legal. However, Georgescu’s lawyers contested this decision at the Bucharest Court and requested that the file be sent to the General Prosecutor’s Office.
A third judge will decide
In the absence of a consensus, the court ordered the formation of a panel of divergence, by appointing a third judge. The next deadline has been set for Monday, February 9, 2026.
“On the basis of Article 394 paragraph 5 of the Civil Code, it finds that the divergence has been avoided, so that the trial of the case will be resumed in full on the divergence. It sets a deadline of 09.02.2026, at 11:00 a.m.“, it is stated in the decision of the Bucharest Court, pronounced on February 6, 2026, quoted by Agerpres.
The accusations of the General Prosecutor’s Office
Călin Georgescu was sent to court on July 2, 2025, under judicial control, being accused of promoting in public the cult of persons guilty of genocide, crimes against humanity and war crimes, as well as the promotion of fascist, legionary, racist or xenophobic ideas, in a continuous form.
According to the indictment, between June 16, 2020 and May 16, 2025, he would have repeatedly promoted legionary and fascist ideas, supporting the need for a charismatic authoritarian leader, glorifying the historical past and promoting ultra-nationalism with a mythical Christian core. Prosecutors also mention the cult of Marshal Ion Antonescu, convicted of war crimes, including performing the legionary salute in University Square on October 2, 2021.
Investigators claim that Georgescu watched “normalization and revitalization of legionnaires” by eulogizing statements addressed to Corneliu Zelea Codreanu, Ion Antonescu and Ion Moța.
