The retrial of Harvey Weinstein’s rape trial ended without a verdict on Friday after a New York jury said it could not reach a unanimous verdict. Despite the mistrial, the former Hollywood mogul remains in custody for other sex crimes.
Judge Curtis Farber declared a mistrial after jurors told the court they could not reach a unanimous decision on the allegation that Harvey Weinstein raped actress Jessica Mann in 2013, the Associated Press reports.
The jury’s deliberation lasted three days. After informing the judge that they had concluded they could not reach a joint verdict, the court initially asked them to continue deliberations, according to New York state court practice.
A new hearing has been scheduled for June 24, when prosecutors will decide whether to request a fourth trial in the case.
Manhattan District Attorney Alvin Bragg said he was disappointed by the outcome but respected the jury’s decision.
He stated that authorities will speak with Jessica Mann before making a decision on further proceedings.
The trial, also canceled in June of last year, is a resumption of the one in 2020 that had sentenced him to 23 years in prison, but which was canceled by the New York Court of Appeals in 2024, on the grounds that the original court accepted inadmissible testimony.
Also in June 2025, Weinstein was found guilty of assaulting former production assistant Miriam Haley in 2006 and acquitted of another charge related to Kaja Sokola.
Despite the impasse, Weinstein remains in custody, having already been sentenced to 16 years in prison in California for another rape.
