After the Constitutional Court decided that the law granting performance scholarships only to students from state schools is unconstitutional, the Ministry of Education declared that it will comply with the decision, but is waiting for the publication in the Official Gazette.

On Friday, the Ministry of Education informed that it will comply with the decision of the Constitutional Court according to which the law that provides performance scholarships only for students from state schools is unconstitutional and will undertake, after publication in the Official Gazette, all the necessary legal steps.
“The Ministry of Education has taken note of the solution ordered by the Constitutional Court regarding the provisions of Education Law no. 1/2011. The decision was pronounced as a result of the resolution of the exception of unconstitutionality formulated in file no. 33184/299/2018, pending before the Bucharest Court. Considering the fact that the decisions of the CCR are binding erga omnes for the future, the Ministry of Education will comply with the decision both in the spirit and in the letter of the considerations contained therein”. it is stated in a statement sent to Agerpres.
The representatives of the ministry added that, after the publication in the Official Gazette of the decision of the CCR, “all necessary legal steps will be taken”.
“At this moment, we are not aware of the content of the decision, which will be published in the Official Gazette. According to art. 147 of the Constitution, the CCR Decision is mandatory and must be implemented within 45 days of its publication in the Official Gazette of Romania. Therefore, at this moment, having no other data, except for those in the public space, the Ministry of Education cannot take any action, following that, after the publication in the Official Gazette, all the necessary legal actions will be taken”.

We remind you that on Thursday the Constitutional Court of Romania ruled that the law that provides that only students enrolled in the state pre-university education system can benefit from the performance scholarship is unconstitutional, considering that those who study in private educational institutions and achieve performances in various domains.
