The controversy regarding the possible incompatibility of the Minister of Defense, Radu Miruță, takes on new dimensions after the appearance of information that contradicts the official’s statements. Antena 3 CNN presented documents on Friday evening that would show that Miruță continued to exercise the activity of judicial technical expert while he was a deputy, although he publicly claimed that he did not perform any expertise during this period.
According to sources cited by the TV station, the National Integrity Agency would have opened an investigation following these revelations.
Expertise submitted to the court, although the minister denied the activity
The documents presented show that, on February 21, 2023, Radu Miruță submitted a technical expertise in a civil case at the Pitesti Court, more than two years after he had been elected deputy. The expertise had been requested by the court, and the fee had been paid by the interested party.
However, the Minister of Defense has repeatedly stated that he did not perform any work during the period in which he simultaneously held the capacity of parliamentarian and judicial technical expert.
A document from 2021 contradicts Miruță
Antena 3 CNN also presented a document from October 14, 2021, sent by Miruță to the Mizil Court, in which he announced that he could no longer carry out expertise because he had been elected to a public position and had suspended his PFA through which he carried out his activity.
In the message sent to the court, Radu Miruță explains that, although he remains a judicial technical expert, he can no longer carry out work because he no longer has the legal instrument through which he was paid, the PFA.
The Ministry of Justice confirmed for Antena 3 CNN that a parliamentarian is incompatible with performing commercial acts as a natural person, which means that the suspension of the PFA legally prevented Miruță from carrying out expertise, reports the quoted source.
However, in 2023, Miruță signed and submitted an expert opinion in court, although his PFA was still suspended, reports the quoted source.
DIICOT file blocked for six months
Another situation that raises questions dates back to 2022, when Radu Miruță was appointed an expert in a DIICOT file regarding an IT fraud of three million euros, pending before the Bihor Court.
A telephone note drawn up by the clerk shows that Radu Miruță was contacted repeatedly, but either did not answer or rejected the calls. In the end, the case was closed by prescribing the facts, and the defendant was acquitted.
Radu Miruță was fined by the court with 3,000 lei for the delay, but he claimed that he does not see any problem, stating that the activity of an expert is one that he does “within the limits of time and availability”.
Legal status of the PFA
According to data from the Trade Register, Radu Miruță’s PFA was suspended between January 19, 2021 and January 18, 2024. Later, it automatically became active again and was only written off at the end of 2024.
This period raises questions regarding compatibility, as the status of deputy prohibits the carrying out of commercial activities as a natural person.
According to Antena 3 CNN, the National Integrity Agency would have reported itself after the disclosure of the expertise submitted to the Pitesti Court.
