AEP wants to put ANAF on the trail of parties that refuse to pay their fines

The President of the Permanent Electoral Authority, Adrian Ţuţuianu, had a meeting with the head of ANAF, Adrian Nica, on Thursday. The two discussed the possibility of concluding a collaboration protocol between the two institutions regarding the forced execution of contraventional sanctions and confiscation measures ordered by the AEP to political parties and electoral competitors.

According to a press release from AEP, the opportunity to conclude a collaboration protocol with ANAF was analyzed in order to improve institutional cooperation in areas such as the enforced execution of contraventional sanctions and confiscation measures ordered by the Permanent Electoral Authority to political parties and electoral competitors, as well as monitoring their implementation, according to Agerpres.

AEP specifies that, at present, the legal framework does not allow it to systematically monitor the implementation stage of enforced executions as a result of contraventional sanctions and confiscation measures ordered in the exercise of its legal powers.

“In the absence of formal information exchange and reporting mechanisms between the competent institutions, AEP does not benefit from updated data on the implementation of these measures, a situation that limits the authority’s ability to evaluate the impact and efficiency of the control activity carried out in the field of financing political parties and electoral campaigns. In this context, the consolidation of institutional cooperation is an essential premise for increasing the degree of compliance with legal provisions and for ensuring a more effective monitoring of the measures disposed”, it is explained in the press release.

At the same time, the discussions concerned aspects related to the verification of donations and loans granted to electoral competitors and political formations and their financing through online platforms, as well as the need for collaboration to identify legislative solutions, including regarding the running of political and electoral advertising campaigns in the online environment.

“In the context of the transformations generated by the accelerated technological advance and the continuous evolution of the digital environment, the state institutions must consolidate their cooperation and combine their efforts to ensure compliance with the legal provisions, within the limits of the specific competences of each authority, thus contributing to increasing the transparency, integrity and efficiency of the control and supervision mechanisms in the field of financing political and electoral activity“, said Adrian Ţuţuianu, according to the quoted statement.

An analysis published by Expert Forum (EFOR) shows that political parties, candidates and financial trustees paid only 7% of the value of the fines and 3% of the sums confiscated by the Permanent Electoral Authority (AEP) in the years 2024 and 2025, the rest being blocked in court or sent to enforcement.

Of the total fines of 6.17 million lei applied by AEP, only 450,000 lei (7%) were collected. The situation is even more dramatic in the case of confiscations: out of 26.2 million lei, the state recovered only approximately 885,000 lei, equivalent to 3% of the total.
