Judge Mary Marlowe Sommer says prosecutors have no case to reverse her decision. Prosecutor Kari Morrissey says she disagrees with the ruling, and will appeal it.
The case was dismissed mid-trial after it was discovered that police and prosecutors withheld defense evidence.
Baldwin’s trial was disrupted by revelations that ammunition was brought to the Santa Fe County Sheriff’s Office in March by another man who may be connected to Hutchins’ murder, Mediafax writes.
Prosecutors say the ammunition is unrelated to the case, but lawyers say investigators “buried” the evidence in a separate file and successfully filed a motion to dismiss.
According to the indictment, the bullets do not match the one who killed Hutchins, a cinematographer from Ukraine.
“It’s a false track”said prosecutor Kari Morrissey. “This has no probative value,” she added.
In 2021, on the set of the movie Rust, Alec Baldwin fired a prop gun from the set, fatally shooting a woman. Halyna Hutchins, 42, was a cinematographer. She was taken to hospital but died from her injuries.
A spokesman for Baldwin said there was an accident on set when a blanking gun accidentally went off.
