The USR submitted a bill by which the license and the sticker no longer have to be presented physically, if the Traffic Police can check the data directly in the system.
In Romania you are fined if you forgot your driver’s license or car registration number at home. A bill submitted by USR deputy Alexandru Dimitriu aims to eliminate this situation, since the police can check this aspect in the computer system, in just a few seconds.
“I submitted a bill in Parliament that would no longer sanction this situation, as long as the police can electronically check the data in the official database. Because the reality is simple: the lack of paper is not the problem, but whether or not you have the right to drive. And this can be checked in a few seconds. At the moment, the law sanctions the physical failure to present the documents, even when they exist and can be checked immediately. It is an outdated formalism, which does nothing to contribute to safety traffic, but it can generate unnecessary sanctions. My project proposes a simple solution: the obligation to present the documents is considered fulfilled if the information can be checked in the Traffic Police databases”says the deputy in a post on Facebook.
Alexandru Dumitru states that it is a natural step in a modern administration, where the state uses technology to simplify citizens’ lives, not to sanction them unnecessarily.
What does the law say today?
“Traffic participants are obliged, at the request of the traffic policeman, to hand him their identity document or, as the case may be, their driver’s license, registration or registration document of the vehicle they are driving”according to ART. 35 (2), from law 195/2002.
Therefore, those who are pulled over must always present the original ID card or passport, driver’s license and ticket to the police officer.
The only exception to the “rule” is represented by the RCA insurance, which can be handed out either in electronic format or as a xerox copy.
