A ten-day vacation in Romania had unexpected consequences for a family staying in an emergency center in Berlin, who ended up seeking justice in court.
A Romanian family staying in a center for homeless people in Berlin was left without the place they received from the authorities after going on vacation in Romania for ten days. When they returned to Germany, the parents and the two teenage children asked to be readmitted to the social assistance center, but the authorities refused, reports Bild.
In mid-July, the parents and the two children announced that they were leaving for Romania. They knew that a longer absence could affect their right to return to the center. After ten days they returned to Berlin and asked to be given a place again, but their request was rejected by Hannes Rehfeldt, councilor for social affairs in the Neukölln district and a member of the CDU.
“Those who spend their holidays in their home country can also live there permanently and do not have to receive state-paid social benefits and accommodation in Germany“, he justified his decision.
According to the same source, the Romanian couple already had a difficult relationship with the center’s administrator, who says that the two consumed alcohol, smoked in the room and received visitors from outside the center, violating the internal order regulations. For these violations, they had previously received a warning.
The court’s decision
The two Romanians went to the Administrative Court in Berlin and submitted an emergency request, in which they asked the court to compel the authorities to receive them again in the accommodation center in Friedrichshain, at least until the final resolution of their situation.
However, the judge rejected their request. In justifying the decision, she showed that the condition that the lack of housing was “involuntary” was not met, considering that the Romanian family chose to leave the center where they were accommodated, although they knew that they did not have a guarantee of a place upon their return, and, for this reason, the authorities have no obligation to accommodate them in that center again.
Accommodation of 5,400 euros per month
The Romanian couple benefited not only from a place in the emergency center, but also from financial support from the German state. The parents, as citizens of the European Union, could live and work in Germany, and their income could be supplemented with social benefits, under the conditions laid down by law.
The Jobcenter had established a requirement of 1,700 euros for the family. After the reduction of the child allowance, the family received 1,012 euros per month.
Accommodation was paid for separately by the German state and cost 180 euros per day. The rate was calculated at around 45 euros for each of the four family members, so the amount came to around 5,400 euros per month.
